These Terms and Conditions (hereinafter – Terms) govern the purchase of goods through the website xxxxxxxxxxxxx, operated by MB “Adsera” (hereinafter – we, us, our). The Terms are drafted in accordance with applicable European Union consumer protection directives and mandatory national law.

2. Scope of Application
These Terms apply to all purchase agreements concluded via the Website.
These Terms do not limit or exclude any mandatory consumer rights granted under applicable European Union or national legislation.
3. Eligibility to Purchase
Purchases may be made by natural persons who:

are at least 16 years of age, or
-
have reached the minimum legal age to enter into binding contracts under applicable law.
Customers must provide accurate, complete, and up-to-date personal and payment information when placing an order.
Legal entities or individuals wishing to purchase goods based on a pre-invoice must contact customer support prior to placing an order.
4. Product Information
We take reasonable care to ensure that product descriptions, prices, and images are accurate. However, due to differences in device displays, product colors or appearance may differ slightly from those shown on the Website.
5. Orders and Contract Formation
Placing an order constitutes an offer to purchase goods.
The purchase contract is concluded only once we send an explicit order acceptance confirmation by e-mail.
We reserve the right to refuse or cancel an order if:

payment cannot be processed or authorized;

the product is unavailable or withdrawn from sale;

delivery to the specified territory (Latvia) is restricted;

incorrect or misleading information is provided;

these Terms are violated.
If an order cannot be completed, the customer will be informed by e-mail.
6. Prices and Payment
All prices displayed on the Website are in euros (EUR) and include applicable VAT and taxes.
Delivery costs are not included in the product price and are displayed separately during checkout.
Payment methods may include:

online banking or Paysera;

cash on delivery (where available; additional fees may apply).
We are not responsible for delays or cancellations caused by payment service providers.
7. Delivery
7.1 Delivery Methods
Customers may choose one of the following delivery options:

Courier delivery – delivery to the customer’s address within approximately XXX business days after payment;

Pickup points and parcel lockers – delivery to designated pickup locations.
Shipment limits:
-
maximum shipment weight: 20 kg;
-
courier parcel dimensions: longest side 100 cm, maximum total length 200 cm;
-
parcel locker sizes: XS, S, M, L (maximum size 37 × 44 × 61 cm).
Free shipping is offered for orders over €200, as indicated on the Website.
7.2 Inspection Upon Delivery
Upon receiving the goods, the customer must:

inspect the external condition of the package before signing the Proof of Delivery (POD);

verify that the number of packages corresponds to the delivery documentation;
-
note any visible damage or discrepancies in the delivery documents or refuse delivery where appropriate.
7.3 Risk and Title
Ownership of the goods and the risk of loss or damage passes to the customer upon delivery of the goods.
Delivery is carried out by third-party carriers (DPD, DHL, UPS, Omniva, or other selected carriers), which are responsible for the delivery process.
Delivery times are indicative only and may be affected by circumstances beyond our control.
8. Right of Withdrawal and Returns
8.1 Statutory Right of Withdrawal (14 days)
In accordance with EU consumer protection law, consumers have the right to withdraw from the purchase contract within 14 days from the day the goods are received.
To exercise this right, the customer must notify us by e-mail within the withdrawal period.
8.2 Refunds
Refunds are issued using the same payment method used for the original transaction.
Refunds will be processed within 14 business days after receipt and inspection of the returned goods.
9. Defective Goods and Warranty
If goods are defective or do not conform to the contract, the customer has the right to submit a warranty claim in accordance with applicable law.
Complaints should be submitted by e-mail with a description of the defect and supporting evidence where possible.
The HESTER M3 model is covered by a five (5)-year warranty.
All other models are covered by a standard two (2)-year warranty.
10. Limitation of Liability
To the maximum extent permitted by law, our liability is limited to the price paid for the purchased goods.
We are not liable for indirect or consequential damages, except where liability cannot be excluded under mandatory law.
11. Force Majeure
We shall not be liable for failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to natural disasters, strikes, or transport disruptions.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Lithuania.
Consumer disputes may also be brought before the courts or authorities of the consumer’s place of residence, where applicable under EU law.
13. Amendments to the Terms
We reserve the right to amend these Terms at any time. Amendments become effective upon publication on the Website.
